UK Brands Lose Right to Own Names
in China- No Need to Panic?

The Daily Telegraph Business section reported 30 April 2012 the results of a survey by the newspaper into the registration in China by third parties of well-known UK brands, such as Top Shop, Sainsbury's and others. This comes about because of the so-called first to register trade mark system in China and most other countries outside the UK, whereby the trade mark right is acquired by the first person to register the mark and not necessarily the first person to use it. This can result in companies slipping in and registering ahead of the rightful owner. As a registered trade mark gives an exclusive right to the owner, that will exclude everyone else from the market.
However, UK and International trade mark owners have coped with first to register trade mark registration systems for many years in Continental Europe and the approach to China needs to be no different. Michael Cover acts a Judge at the
9th Vis East Moot in Hong Kong

Michael Cover has acted as a Judge at the 9 th Vis East Moot Arbitration Moot in Hong Kong. This event, held between 19 to 25 March 2012, brought together 91 teams from universities and law colleges from every continent. The competition involved the teams battling it out in mock arbitrations in front of real international arbitrators in an initial pool stage, followed by knockout rounds to the Final Round. Marks were awarded for organization and preparation, presentation, structure of the arguments and handling questions and legal reasoning.
The Competition used the new CIETAC (China International Economic and Trade Arbitration Commission) Arbitration Rules, which are due to come in to force shortly later in 2012. The winners were the host university, City University of Hong Kong, Law School, last year’s winners, Bond University of Australia, having gone out in the quarter finals.

As announced recently, Michael Cover is a member of the Sport Resolutions Panels of Arbitrators and Mediators. Sport Resolutions is the independent dispute resolution service for sport in the UK, offering arbitration, mediation and panel appointment services. Michael has been reappointed in the mediation category.
Michael is also on the arbitration and mediation panels of Just Sport Ireland, the independent dispute resolution body for Irish Sport.

the 7th ICC International Mediation
Competition

Michael Cover acted as a Judge at the 7th ICC International Commercial Mediation Competition, which was held in Paris from Friday 3 to Wednesday 8 February 2012. This follows his recent involvement as a Judge in the 2nd UK Mediation Skills Competition.
This excellent ICC competition, won by the South Texas College of Law team, brought together 66 University Teams from 32 countries, pitting their skills against each other in mock mediations in front of leading professional mediators.
The focus of the Competition was the effective combination of the use of the mediator, active listening and responding and client representation and teamwork. For each mediation, the teams fielded two students, one playing the role of the client and the other the client’s lawyer.

Mediation Skills Competition

Michael Cover acted as a Judge in the Second UK Mediation Skills Competition organized by the Worshipful Company of Arbitrators over the weekend of 14/15 January 2012. As an experienced mediator, Michael was able to bring his skills to bear in the opening round and semi-finals, which saw teams from 14 top UK Universities and Law Schools pit their problem-solving skills against each other in mock mediations. These mediations were guided by other top professional mediators. The winners and runners-up, London Metropolitan University and the University of Northumbria, were both able to progress to the ICC International Commercial Mediation Competition in Paris between 3 and 8 February 2012.
Michael commented: "I was delighted to be able to contribute to the success of this second UK Mediation Skills Competition and look forward to acting as a Judge again in Paris at the ICC International Commercial Mediation Competition."

Matthew Rushton Ignites Debate at
the Mediators' New Breakfast Club

The Mediators' New Breakfast Club continued its trend with guest speaker Matthew Rushton of JAMS International. On 15th November 30+ mediators met at the Punch Tavern on Fleet Street, London for breakfast and networking. Matthew was able to give an engaging if not controversial talk as a talented legal reporter with a unique ADR background.
In 2007 Matthew founded Empirical Publishing, an online legal publisher focused on ADR. Matthew was the publisher of the Mediator Magazine and later The Mediator Directory , the latter becoming the UK's first national feedback repository for users of commercial mediation. In 2009, Matthew launched an ADR brokerage site, DisputesLoop.com , designed to bring together ADR users and practitioners. In tandem with the above, Matthew worked as a consultant advising in relation to a number of ADR-related events.

The Mediators' New Breakfast Club on 13 September 2011 was addressed, by Christopher Young, who has been marketeer in both City law firms and the world of mediation. He emphasized the need, in marketing professional services in general and mediation in particular, to focus on as few as 30 clients and contacts and the need to contact these regularly and maintain dialogue with them. He also emphasized that these 30 clients and contacts needed to be reviewed and perhaps that 10 might be changed over a year. This was well-received by the 25 or so mediators present.
The next meeting has now been fixed for 0845 on Tuesday 15 November 2011 at the Punch Tavern, 99 Fleet Street, London EC4. The speaker will be Mathew Rushton, the former Editor of The Mediator Magazine and now Deputy-Managing Director of JAMS International. A New Epoch for Mediators

Divorce this decade has become synonymous with uncivilised disputes and undignified legal proceedings putting a strain on all parties involved, including children. However, we are now beginning to see hopeful signs that an amicable separation will soon be easier to obtain. Experts point towards a new epoch in which mediators will take the lead in resolving family disputes, offering an accessible route to help couples move on gracefully.
In this shake-up of the Family Justice System, divorcing couples will be ordered to consider mediation before entering the divorce court. New rules, which came into effect on 6 th April, 2011, will see couples who cannot agree how to divide up their belongings and share responsibility for their children having to attend a mediation awareness session.
Instead of a judge ruling on the details of their divorce, they will be encouraged to hammer out a deal with the help of trained mediators in an attempt to prevent the…
