Draft General Scheme of Mediation
Bill 2012 published in Ireland

The Draft General Scheme of Mediation Bill was published in Ireland on 1 March 2012. This builds on the recommendations of the Irish law Reform Commission Report "Alternative Dispute Resolution- Mediation and Conciliation" and a further report back on the Bill is called for by 1 June 2012.
Whilst the approach may be unpopular with those that see mediation as a free and easy and flexible process, the Bill contains a number of interesting provisions, including proposing imposing a duty on Irish solicitors and barristers to provide information on mediation. It also provides that the mediator may make proposals to settle the dispute but only with the agreement of the parties and that the mediator shall inform the parties of his or her training and experience of mediation, that the mediator should report back to the court where the mediation is as a result of court intervention and extends the limitation period by 30 days to cover the estimated time for the mediation. The next meeting of The Mediators' New Breakfast Club will be held at 0815 for 0845 on Tuesday 13 September 2011.
We are reverting to The Punch Tavern, 99 Fleet Street, London EC4Y 1DE tel 0207 353 6658, as, very unfortunately, staying at Lutyens would have meant doubling or even trebling the price. Accordingly, the price will remain at £5 per head, payable on the day. We will use the back room at The Punch, which should be quieter.
Our guest will be Christopher Young, who has been involved in marketing and business development at major City law firms and also in the world of mediation. His special subject is CRM or customer relationship management, so we look forward to welcoming him and dealing with what is always the Achilles Heel of professional services, including mediation.
